Terms & Conditions
Last updated [[EFFECTIVE DATE]]
This is a working draft pending review by a qualified lawyer. Some details are still marked with placeholders. Do not rely on it as a final agreement.
1. About these Terms
These Terms & Conditions (the “Terms”) are a binding agreement between you and:
- [[LEGAL ENTITY NAME]] (“GeoPilot”, “we”, “us”, “our”),
- [[REGISTERED ADDRESS]], Romania,
- registration / VAT number [[COMPANY / VAT NUMBER]],
- contact: [[SUPPORT EMAIL]].
They govern your use of the GeoPilot website, application and services at [[SITE DOMAIN]] (the “Service”). By creating an account, or by otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy and Cookie Policy are incorporated into these Terms by reference.
If you are using the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf, and “you” means that organisation.
2. Eligibility
- You must be at least 16 years old to create an account.
- To purchase a paid plan you must be at least 18 years old and have the legal capacity to enter into a contract, or have the consent of a parent or guardian.
- You agree that the information you give us is accurate and that you will keep it up to date.
3. What the Service is
GeoPilot aggregates airspace-restriction information made publicly available by national aviation authorities and air-navigation service providers, normalises it into a single map, and provides tools to help you plan uncrewed-aircraft (“drone”) operations. Depending on your plan, this includes an interactive map of airspace restrictions across the countries we cover; drawing, saving and exporting flight areas; a check that lists the restrictions a drawn area or route intersects; recurring re-checks of a saved plan against a chosen flight time; SORA operational-volume dimensioning; and PDRA eligibility screening. Separately, a public API (sold on its own, see section 8A) reads the restriction data we are licensed to redistribute and converts between geozone file formats.
GeoPilot is an independent service. It is not operated by, affiliated with, or endorsed by the European Union Aviation Safety Agency (EASA), the Federal Aviation Administration (FAA), or any national aviation authority or air-navigation service provider whose data it displays. Naming a publisher identifies where the data came from; it does not mean that publisher has approved or reviewed the Service.
4. GeoPilot is a planning aid — NOT an authoritative source
This section is important. Read it.
4.1 The Service is a planning and information aid only. It is not an official source of aeronautical information and does not constitute authorisation to operate a drone.
4.2 It is not a substitute for, and you must not rely on it instead of:
- the official pre-flight information bulletin (PIB) and NOTAMs;
- the Aeronautical Information Publication (AIP) and the competent authority’s published UAS geographical zones;
- any operating authorisation, declaration, permission, or approval required for your operation; or
- direct contact with the relevant air-navigation service provider or authority.
4.3 The data may be wrong, incomplete, generalised, delayed or unavailable. It comes from third-party publishers on their own schedules and in their own formats; we normalise and simplify it (including simplifying the shape of zones), and errors or gaps in the source data will be reflected in the Service. We do not independently verify the source data and make no representation or warranty that it is accurate, complete or current. Restriction times are shown in UTC.
4.3a The absence of a restriction in the Service — on the map, at a point, or in a conflict check — does not mean that flight is permitted there. Not every country, restriction type or temporary restriction is covered, and a source may publish a change before the Service next synchronises it.
4.4 The SORA and PDRA tools are screening aids only. They are not a complete SORA risk assessment, not a compliance dossier, not an operational authorisation or airworthiness approval, and not advice. They rely entirely on the parameters you enter (including population density and airspace class, which you declare and which we do not model), and they list considerations without reaching a conclusion. The published method’s own disclaimer applies and is shown alongside the result.
4.5 You are solely responsible for the planning, legality and safety of every operation, including verifying all information against the official sources, obtaining every required authorisation, and complying with Regulation (EU) 2019/947, Regulation (EU) 2019/945, the rules of the state of operation and any specific-category conditions that apply to you.
4.6 The conflict check and the “lists, never concludes” outputs are provided for information. A result that finds nothing is not a permission, and a result that lists something is not a refusal.
5. Your account and security
- Keep your password confidential. You are responsible for activity under your account unless it results from our failure to keep the Service secure.
- Tell us promptly at [[SUPPORT EMAIL]] if you believe your account has been compromised.
- We may suspend or limit your account where we reasonably believe it is necessary for security or to comply with the law.
6. Acceptable use
You agree not to:
- use the Service unlawfully, or to plan or support an operation that would endanger aviation safety or any person;
- extract, scrape or bulk-download the airspace data other than through the export features we provide or, within its limits and licence terms, the public API (section 8A), or use automated means to access the Service beyond ordinary use. The data requests the map makes to draw itself are the map’s own transport, not a licensed data feed, and must not be used as one;
- resell, redistribute or sublicense the airspace data or the Service, or build a competing dataset or product from them, except as permitted by the upstream licences (section 8);
- probe, scan, overload or circumvent the Service’s security, rate limits or entitlement checks;
- upload or share content — including in plan names, notes and shared links — that is unlawful, infringing, defamatory, or that contains another person’s personal data without a lawful basis; or
- misrepresent the Service’s output as official authorisation to any third party or authority.
We may remove content or restrict access that we reasonably believe breaches this section.
7. Your content
7.1 You keep all rights you have in the flight plans, drawn areas, assessments, names and notes you create (“Your Content”).
7.2 You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example, to reproject or simplify geometry) and display Your Content, solely to operate and provide the Service to you and — only where you choose to create a share link — to the people you share it with.
7.3 You are responsible for Your Content, for having the right to provide it, and for anyone you give a share link to. A share link makes the shared item readable by anyone who has the link until you revoke it or it expires.
7.4 Coordinates and files you export are yours to use. They are provided for your planning and you use them at your own risk (see section 4).
8. Third-party airspace data and licences
8.1 The airspace data displayed in the Service originates from third-party publishers (national aviation authorities and air-navigation service providers). Each source is published under its own licence and terms, which the Service identifies per source in the data-status panel on the map: each source’s credit line and licence, or a statement that the publisher gives no reuse terms.
8.2 Some sources restrict commercial use, redistribution or the creation of derivative works (for example, data published under a “no-derivatives” or “non-commercial” licence).
8.3 We grant you no rights in the third-party data beyond what the relevant upstream licence allows. Before you reuse, publish or redistribute any airspace data obtained through the Service, you must check and comply with that source’s licence, including any attribution requirement, which passes through to you.
8.4 The official sources are the property of their respective publishers. Nothing in these Terms transfers any right in them to you or to us beyond the applicable licence.
8A. The public API
8A.1 Access to the GeoPilot public API (/api/v1/public) is a separate product from the map plans — including the Lifetime plan — and is purchased on the API access page or granted by us. The API documentation at /api-access/docs is incorporated here.
8A.2 Keep your API keys secret. You are responsible for all use made with your keys. If a key may have been exposed, revoke it from your profile at once. We may revoke or suspend a key, or your API access, where we reasonably believe it is necessary for security, to prevent abuse, or because of a breach of these Terms.
8A.3 Each key is subject to the request and data-volume limits stated in the documentation. You must not circumvent them — for example by spreading one integration across several keys or accounts.
8A.4 The API serves restriction data only from sources whose published licence permits commercial use and redistribution; the countries it covers are listed on the API pages. Other sources are not served, and a conflict check through the API names any such source it left out rather than reporting the area as clear. The upstream licence of each source passes through to you and to anyone you pass the data on to — in particular any attribution requirement: each response carries the source’s own credit line, and where you display the data you must show it (for a CC BY 4.0 source, that includes the licence and an indication that the data was modified).
8A.5 Files you submit for format conversion are processed only to return the converted result and are not kept; only the usage record described in the Privacy Policy is.
8A.6 Section 4 applies equally to anything the API returns. Where you show API output to others, you must not present it as official, complete or current, or as an authorisation, and you must make clear that the data comes from the named national publishers through an independent service.
8A.7 We do not offer a service-level guarantee for the API. We may change it; changes that affect existing integrations are announced in the changelog on the documentation page, with reasonable notice where practicable.
8A.8 Sections 9 to 11 apply to paid API access as they do to map plans, from the launch of paid plans.
9. Plans, pricing and payment (effective from launch of paid plans)
9.1 The Service has a free tier and paid plans. The plans, their features and their prices are shown on the plans page (and, for API access, on the API access page) and are incorporated here. Current paid map plans are Monthly, Yearly and Lifetime, priced in euro (EUR); we may add, change or withdraw plans and promotional price points, without affecting a plan you have already bought for its current period. A 14-day trial of the paid features may be offered; at the end of the trial your access returns to the free tier unless you subscribe.
9.2 Prices are shown [[inclusive / exclusive]] of VAT. Where VAT or another tax applies, it will be shown before you confirm payment and on your invoice.
9.3 Payments are processed by Stripe. By subscribing you also agree to Stripe’s terms and authorise us and Stripe to charge your chosen payment method for the plan you select and, for recurring plans, for each renewal until you cancel.
9.4 Monthly and Yearly plans renew automatically at the end of each billing period at the then-current price for that plan, unless you cancel before the renewal date. The Lifetime plan is a single payment and does not renew.
9.5 We may change plan prices. For recurring plans, we will give you at least 30 days’ notice by email, and the new price will apply from your next renewal; you can cancel before then if you do not accept it.
9.6 If a renewal payment fails, we may retry it and may suspend the paid features until payment succeeds. If payment is not made within a reasonable period, the subscription may be cancelled and your access returned to the free tier.
9.7 Moving from one plan to another takes effect immediately; the unused part of the previous plan is not refunded or credited. [[Confirm with counsel against consumer law before paid plans launch.]]
9.8 We may give access to paid features free of charge — for example to beta testers or early adopters — for a stated period or until we end it. Such access ends automatically when its period does, we may revoke it on notice, and no payment terms apply to it.
10. Right of withdrawal for consumers (effective from launch of paid plans)
10.1 If you are a consumer in the EU/EEA, you normally have the right to withdraw from a distance contract within 14 days without giving a reason, under Government Emergency Ordinance no. 34/2014 (which implements Directive 2011/83/EU).
10.2 The Service is a digital service supplied immediately. When you subscribe, you will be asked to expressly request that we begin providing the paid features immediately and to acknowledge that you will lose your right of withdrawal once provision has begun. If you give that consent and we begin providing the paid features, your 14-day right of withdrawal is lost.
10.3 If you have not given that consent, or provision has not yet begun, you can withdraw within 14 days by a clear statement to [[SUPPORT EMAIL]] (you may use the model withdrawal form in Annex A below). We will refund all payments received from you within 14 days of being informed, using the same means of payment you used.
10.4 Nothing in this section affects your separate statutory rights if the paid features are not as described or not of the required standard (see section 15).
11. Cancellation and refunds (effective from launch of paid plans)
11.1 You can cancel a recurring plan at any time from your account. Cancellation takes effect at the end of the current billing period; you keep the paid features until then and are not charged again. Cancelling the Lifetime plan takes effect immediately.
11.2 Except where section 10 applies, where the law requires a refund, or where we are in material breach, payments are non-refundable and we do not provide partial-period refunds.
11.3 Your access to the paid features ends when your paid period ends.
12. Availability and changes to the Service
12.1 The Service is provided on an “as is” and “as available” basis. We do not guarantee that it will be uninterrupted, error-free, or available at any particular time, and we do not currently offer a service-level guarantee.
12.2 We may change, add, or remove features, and we may suspend or discontinue the Service. If a change is likely to have a material adverse effect on you, we will give you reasonable prior notice where practicable, and if you have a paid plan you may cancel and receive a pro-rata refund of any prepaid, unused period.
12.3 We may carry out maintenance that makes the Service temporarily unavailable.
13. Suspension and termination
13.1 You can stop using the Service at any time and delete your account from your profile.
13.2 We may suspend or terminate your access, with notice where practicable (and immediately where necessary), if you materially breach these Terms and do not fix a fixable breach within a reasonable time; if your use poses a security, legal or safety risk; or (for paid plans) if payment is not made when due.
13.3 On termination your right to use the Service ends. We will delete or anonymise your personal data in line with the Privacy Policy. Sections that by their nature should survive (including 4, 7.3–7.4, 8, 8A.4, 14, 15, 16, 17, 18 and 20) continue to apply.
14. Intellectual property
The Service, including its software, design, user interface, branding, text and the compilation and arrangement of the airspace data, is owned by us or our licensors. These Terms do not transfer any of those rights to you. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms and your plan. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them.
15. Warranties, and your statutory rights
15.1 To the maximum extent permitted by law, and subject to section 15.2, we exclude all implied terms, conditions and warranties, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
15.2 If you are a consumer, this section does not affect your mandatory statutory rights, including your rights under Government Emergency Ordinance no. 141/2021 (on contracts for the supply of digital content and digital services) and Law no. 296/2004 (the Consumer Code), that the paid features will be as described, fit for purpose and supplied with reasonable skill and care, and your remedies if they are not.
16. Limitation of liability
16.1 Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; gross negligence or wilful misconduct; or any liability that cannot be limited or excluded under Romanian or EU law, including mandatory consumer-protection law.
16.2 Subject to section 16.1, and given the nature of the Service described in section 4:
- we are not liable for any loss or damage arising from your reliance on the Service’s output instead of the official sources, or from any error, omission, delay or unavailability in the third-party airspace data;
- we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of data (beyond our obligation to maintain reasonable backups), loss of goodwill, or business interruption; and
- our total aggregate liability to you arising out of or in connection with the Service and these Terms, whether in contract, tort (including negligence), or otherwise, is limited to: if you have a paid plan, the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or EUR 100; and if you use the free tier only, EUR 100.
16.3 If you are a consumer, statutory limits and remedies under Romanian and EU consumer law apply in addition to (and where more favourable, instead of) this section.
17. Indemnity
If you are using the Service other than as a consumer, you agree to indemnify us against reasonable losses, damages and costs we incur arising from your breach of these Terms, your misuse of the Service, or Your Content. If you are a consumer, this section applies only to the extent permitted by law and only where the loss results from your deliberate or negligent breach.
18. Governing law and disputes
18.1 These Terms, and any dispute arising out of or in connection with them, are governed by the law of Romania.
18.2 The courts of [[COURT / CITY]], Romania, have jurisdiction — except that, if you are a consumer, (a) you also benefit from any mandatory provisions of the law of your country of residence, and (b) you may bring proceedings in, and may be sued only in, the courts of your country of residence, as provided by Regulation (EU) 1215/2012.
18.3 Please contact us first at [[SUPPORT EMAIL]]. If we cannot resolve a dispute and you are a consumer, you may refer it to the Romanian alternative-dispute-resolution body operating under the National Authority for Consumer Protection (ANPC) in accordance with Law no. 140/2015 and Government Ordinance no. 38/2015 (anpc.ro).
19. Changes to these Terms
We may update these Terms. We will change the “Last updated” date, and for material changes we will give you notice before they take effect. For paid plans, material changes take effect at your next renewal, and continuing a recurring subscription past that date means you accept them. If you do not accept a change, your remedy is to stop using the Service and, for a paid plan, to cancel.
20. General
- Entire agreement. These Terms, the Privacy Policy, the Cookie Policy and your plan details are the entire agreement between us about the Service.
- Severability. If any provision is held unenforceable, the rest remains in effect and the provision is modified to the least extent necessary to make it enforceable.
- No waiver. A failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets, on notice to you, provided your rights are not reduced.
- Force majeure. Neither party is liable for a failure or delay caused by an event beyond its reasonable control.
- Notices. We may give notices by email, by an in-app notification, or by posting on the Service. Send notices to us at [[SUPPORT EMAIL]].
- Language. These Terms are provided in English, which is the governing version. Any translation is for convenience only.
- Order of precedence. If there is a conflict, these Terms prevail over the Privacy Policy and Cookie Policy, except on data-protection matters, where the Privacy Policy prevails.
